Terms & Conditions
1. PT Simia Solusi Indo (“Simia”) owns and / or operates the following websites:
1.8. and several other websites, collectively referred to as “Simia Websites”.
2. These Terms and Conditions of Online Sales apply to all reservations and purchases made online through Simia Websites.
3. Simia Websites enable users to reserve rooms and supplementary services in hotels (“Hotel” or “Hotels”) and purchase services and goods from online shops (“Shop” or “Shops”).
4. Reservations and purchases can also be made via mobile services such as mobile internet or mobile applications. The same Terms and Conditions of Online Sales shall apply.
5. Any user of Simia Websites making an online reservation, purchase or requesting any services through Simia Websites (hereinafter referred to as “Customer”) confirms having received through Simia Websites all necessary information and applicable Terms and Conditions.
6. All reservations and purchased made through Simia Websites or mobile services implies consultation and full and unreserved acceptance of these Terms and Conditions of Online Sales. No reservation or purchase can be made without this unreserved acceptance.
7. The Customer, prior to purchasing any services or goods available on Simia Websites, declares that the reservation or purchase of goods or services is for personal use.
8. The Customer can use Simia Websites to make legitimate reservations and purchases and shall not use it to make speculative, fraudulent and false reservations or purchases.
9. The Customer confirms that he/she is fully able to legally commit to the applicable Terms and Conditions.
10. The Customer confirms that he / she has read, understood and accepted these Terms and Conditions of Online Sales.
11. These Terms and Conditions of Online Sales can be changed at any time, in which event the new version of the Terms and Conditions of Online Sales will apply automatically and immediately to all Customers from the time it is published online.
12. Purchase of goods or services from Shops
12.1. Only goods or services presented and listed as available on Simia Websites can be purchased by the Customer.
12.2. The Customer is solely responsible for his/her choice of goods or services. The Customer confirms that he/she is aware of the nature, the purpose and the terms of the services available on Simia Websites.
12.3. The purchase is deemed accepted by the Customer at the end of the purchase process.
12.4. Purchase Process
12.4.1. The Customer shall respect the below process:

12.4.2. In case the payment is declined after the Customer has confirmed his/her purchase, the purchase will automatically be cancelled.
12.4.3. If payment is made in a currency other than the currency confirmed during the purchase, the Customer will be liable for the conversion fees.
12.4.4. Foreign currency conversions are given as guidance only and are non-binding.
13. Reservations for Hotels
13.1. Only services presented and available on Simia Websites can be reserved by the Customer.
13.2. The Customer is solely responsible for his/her choice of services. The Customer confirms that he/she is aware of the nature, the purpose and the terms of the services available on Simia Websites.
13.3. The reservation is deemed accepted by the Customer at the end of the reservation process.
13.4. Reservation Process
13.4.1. The Customer shall respect the below process:
13.4.2. To find a Hotel, to select a check-in and a check-out date where necessary, to select a room type and rate;
13.4.3. To select, when needed and/or available, additional services;
13.4.4. To check the reservation details, the total price including taxes and the applicable Hotel’s policies and sales conditions related to the selected rate;
13.4.5. To inform the Customer details as required;
13.4.6. To read, understand and accept the Terms and Conditions of Online Sales;
13.4.7. To confirm the reservation;
13.4.8. To guarantee the reservation;
13.4.9. To pay for the reservation (when requested).
13.5. Acknowledgement of receipt of the reservation
13.5.1. The Customer reservation is subject to an acknowledgement of receipt by email.
13.5.2. The email shall summarize the dates (where applicable), the services reserved, the prices, the Hotel concerned, the Hotel’s policies related to the selected rate.
13.6. Guarantee of the Reservation
13.6.1. When requested, the Customer shall provide his/her credit card details as a guarantee of the reservation using a valid credit card.
13.6.2. The Customer shall inform:

13.6.3. In case of a cancellation not done according to the Hotel cancellation policy, the cost of the first night will be debited, unless specified otherwise in the Hotel cancellation policy.
13.6.4. In case of a no-show (where the Customer did not arrive) without any cancellation received by the Hotel according to the Hotel cancellation policy, the cost of the entire reservation will be debited.
13.6.5. In case the guarantee is declined after the Customer has confirmed his/her reservation, the reservation will automatically be cancelled.
13.6.6. The Customer acknowledges and agrees that he/she has read, understood and accepted the sales conditions related to the selected rate and dates of reservations and dates of stay.
13.6.7. The Customer attests to the truth and accuracy of the information submitted for this reservation purposes.
13.7. Payment of the Reservation
13.7.1. For certain special offers and/or packages, payment is required upon reservation.
13.7.2. When the payment is required, the amount is debited once the Customer has confirmed his/her reservation online.
13.7.3. To process with the payment the Customer shall inform:

13.7.4. Prepaid reservations cannot be changed and/or cancelled. Sums paid in advance will not be reimbursed unless specifically mentioned otherwise in the Sales conditions for the related rate.
13.7.5. In case the payment is declined after the Customer has confirmed his/her reservation, the reservation will automatically be cancelled.
13.7.6. The Customer acknowledges and agrees that he/she has read, understood and accepted the sales conditions related to the selected rate.
13.7.7. The Customer attests to the truth and accuracy of the information submitted for this payment purposes.
13.8.1. All reservations are payable in the Hotel’s local currency unless specifically indicated otherwise by the Hotel concerned.
13.8.2. Rates confirmed are inclusive of Government taxes and service charge applicable on the day the reservation and/or purchase is made.
13.8.3. Any change or implementation of new legal or regulatory taxes imposed by the competent authorities will be automatically impacted on the prices shown on the billing date.
13.8.4. If payment is made in a currency other than the currency confirmed on the reservation, the Customer will be liable for the conversion fees.
13.8.5. Foreign currency conversions are given as guidance only and are non-binding.
13.9.1. National or local authorities requests the Customer to complete a registration form upon arrival at the Hotel. A proof of identity shall be provided to the Hotel upon arrival and a copy of the identity proof will be made and kept by the Hotel. The registration form is at the disposal of the local authorities and Simia.
13.9.2. The Hotels’ rooms must be occupied in respect to the Hotel’s policy and to the Safety and Regulations laws in force in the country.
13.9.3. The Customer agrees to use the room responsibly and to respect the comfort of his/her neighbors.
13.9.4. Any behavior contrary to good morals, to public order and to other guests’ safety and security may result in the Hotel requesting the Customer to leave the Hotel without any delay and without any kind of compensation. Sums already paid/prepaid will not be reimbursed.
14. Third Party
14.1. Simia has appointed Online Payment Providers to operate and secure online payments by credit or debit card and bank transfers.
14.2. The validity of payments is verified by Online Payment Providers. Payment cards can be declined for some reasons such as: stolen or blocked card, credit limit reached, incorrect details entered. In case of such a situation, the Customer shall first contact his/her bank and then the Hotel to confirm his/her reservation and method of payment.
14.3. Simia shall not be held responsible in the event an online card payment is declined by Online Payment Providers for any reason whatsoever.
15.1. Simia is as concerned as its Customer about the privacy of any information that the Customer may provide through Simia Website.
15.2. The Customer authorizes Simia to communicate his personal data to third parties only on the condition that such communication is deemed necessary to Simia providing its services as stated in these terms and conditions.
15.4. Online Payment Providers made a professional commitment to Simia to ensure that all possible security, privacy and confidentiality assurance measures are taken.
15.5. The Customer is informed and accepts that his/her IP address is recorded at the time of the reservation or purchase.
16.1. All photos and pictures shown on Simia Website are non-binding and for information purposes only.
16.2. Simia is making efforts to provide pictures and texts as accurate as possible. Despite those efforts, some variations may occur. In such a case, Simia cannot be held responsible for those variations.
16.3. Simia shall not be held responsible for the non-fulfillment or inadequate fulfillment of the reservation or purchase in case of force majeure, actions of third parties and others or in case of a declined prepayment from the Customer’s bank. Simia shall not be held responsible for any direct or indirect damage as a result.
16.4. Some hyperlinks may be displayed on Simia Websites and linked to other websites. Simia cannot be held responsible for the content, the service and possible consequences as a result.
17. Simia Websites Availability
17.1. Simia reserves the right, without notice or indemnity, to temporarily or permanently shut down Simia Websites or its online reservation or purchase pages.
17.2. Simia is not responsible for damages of any nature that may result from these changes and/or from the temporary unavailability or indeed permanent shutdown of all or part of Simia Websites or its associated services, such as the online reservation or purchase pages.
18. Force Majeure
18.1. Simia shall not be held responsible for the non-fulfillment or inadequate fulfillment of the reservation or purchase in the event of a force majeure/ unforeseen events. Force majeure meaning any events beyond the control of Simia.
19. Terms and Conditions of Online Sales Acceptance
19.1. By confirming a Guaranteed reservation or a prepaid reservation, the Customer confirms that he/she has read, understood and fully accepted the Terms and Conditions of Online Sales.
19.2. The confirmation of a reservation or purchase (whether guaranteed or prepaid) constitutes an electronic signature equivalent in value to a physical signature between the parties.
20. Additional Terms & Conditions of Online Sales
20.1. Additional Terms & Conditions of Online Sales may apply for specific Simia Websites.
20.2. Such Additional Terms & Conditions of Online Sales are published on respective Simia Websites where applicable.
21. Applicable Law
21.1. These Terms and Conditions of Online Sales are governed by the law of the Republic of Indonesia.
